Terms of Service

These Terms govern your use of the Payvera website and checkout (collectively, the "Service") operated by Gheorghe SRL ("Payvera", "we", "us"). By using the Service you accept these Terms. If you do not accept them, do not use the Service.

1. Who we are

Payvera is a technology platform that lets businesses (Merchants) accept online card payments through a hosted checkout. Payvera is not a bank, payment institution, or electronic money institution.

All card processing, authorisation, settlement, and merchant payouts are performed by Stripe Payments Europe, Ltd. ("Stripe"), an authorised payment institution regulated by the Central Bank of Ireland. Your payment is governed by Stripe's terms in addition to these Terms.

2. The role of the Merchant

When you pay through a Payvera checkout, your contractual counterparty for the goods or services is the Merchant displayed on the checkout page, not Payvera. The Merchant is solely responsible for:

  • delivery of the goods or services you purchased;
  • refunds, returns, warranties, and after-sales support;
  • any consumer-protection obligations applicable to the sale;
  • the accuracy of prices, descriptions, and tax shown at checkout.

3. Pricing and fees

Payvera does not charge end customers a fee. The price shown at checkout is the price you pay. Payvera earns a commission from the Merchant, deducted by Stripe from the transaction before payout. This does not increase the price you pay.

4. Refunds and chargebacks

Refund requests must be made to the Merchant. If the Merchant approves a refund, Stripe will return the funds to the original payment method, typically within 5–10 business days. Card chargebacks are handled by your card issuer under the applicable scheme rules (Visa, Mastercard).

5. Acceptable use

You may not use the Service to commit fraud, launder money, or attempt to circumvent any payment scheme or sanctions rule. We may decline or reverse any transaction we reasonably believe to be fraudulent or unlawful.

6. Liability

To the maximum extent permitted by law, Payvera is not liable for any loss arising from a Merchant's failure to deliver, the unavailability of Stripe's services, or any consequential damages. Nothing in these Terms limits liability for death, personal injury, or fraud where such limitation is prohibited by law.

7. Governing law

These Terms are governed by the laws of Romania. Disputes will be resolved by the competent courts of Bucharest, without prejudice to the mandatory consumer protection rights of the country of your habitual residence.

8. Changes

We may update these Terms. The "Last updated" date at the top indicates when. If changes are material, we will notify Merchants by email; end-customer-facing changes apply to checkouts performed after the update date.
